Order to Show Cause Brief and Declaration Filed
On October 23, 2009, after New York State temporarily suspended its mandatory flu shot regulation for health care workers (claiming a “shortage” of flu vaccine) the District Court judge in Washington ordered the Plaintiffs (us) to “show cause” why we have legal standing to sue. “Standing” is a technical issue having to do with the right of the particular plaintiffs to be in court complaining about a particular harm.
Last night we filed the responding papers: a memorandum of law and a supplemental certification from Dr. Laibow. Those documents are published here:
