Washington DC – October 9, 2009: Despite the FDA’s intention to begin delivery this week of the n ovel “Swine Flu” 2009-H1N1-A live virus nasal mist vaccine to 90,000 government-approved locations nationwide, six New Yorkers and several NonGovernmental Organizations (NGOs) filed for an Emergency Injunction in the US District Court for the District of Columbia to prevent the distribution of what they believe are illegal, unnecessary and dangerous vaccines.
The case of Null, Laibow et al. v FDA et al. [Docket No. 1:09-cv-01924]challenges the legality of the September 15th licensing of four vaccines prior to any safety testing for what the government calls a “novel flu virus with pandemic potential.” The complaint alleges that the government failed to follow its own rules and applicable legislation in rushing the vaccine approvals in the absence of any of the requisite minimum scientifically sound and appropriate testing for both safety and effectiveness as required by law since 1964.
The New Yorkers are all health care workers who are therefore subject to that State’s new legal mandate (promulgated August 13, 2009) requiring that nearly all of the State’s half million health care workers receive all Federally recommended flu vaccines or lose their jobs. This requirement puts the health care workers in significant jeopardy since these newly approved vaccines have never been tested for either safety or efficacy and may carry major risks.
The lawsuit, announced at a demonstration by the health care workers last week at the State Capitol in Albany on September 29, 2009, is expected to be just one of the suits filed challenging various government “emergency” actions for a flu that has proven (during the just concluded Southern Hemisphere flu season) to be neither pandemic nor virulent despite dire predictions to the contrary and despite a Health Emergency declared by the CDC on April 25, 2009, 11 days after the first alleged death from Swine Flu on April 14, 2009 and a Level 6 Pandemic declaration by the World Health Organization followed on June 11, 2009 (which was only possible since W.H.O. downgraded the definition of a “Level 6 Pandemic”).
The Plaintiffs include health care professionals such as Dr. Gary Null, PhD, a well-known New York nutritionist, Rima E. Laibow, MD, a New York licensed physician who is Medical Director and a Trustee of the Natural Solutions Foundation, Dr. Tedd Koren DC, head of Foundation for Health Choice and four other health care workers covered by the mandate, including a Registered Nurse who has had prior adverse reactions to flu vaccines; a pregnant Nurse’s Aide, a health care student who has been told that she cannot see the patients whom she must see in order to finish her training, and a woman who works in the billing department of a hospital. All have been denied exemptions and told they will lose their positions under the new mandate if they are not vaccinated with all flu vaccines, including the new “Swine Flu” vaccine.
The Complaint alleges that the FDA erred in determining that safety testing was not needed because the 2009-H1N1-A vaccines are a mere “change of strain” not requiring safety testing. The Plaintiffs claim there is no significant scientific agreement that supports the government’s actions. The experts presented by the Plaintiffs include Sarah Schon MD, a Board Certified Immunologist and Paul G. King PhD, a noted analytical chemist with decades of experience in the pharmaceutical industry.
The Plaintiffs further allege that the Live Attenuated Influenza Virus (LAIV) nasal mist vaccine could trigger the very pandemic the government claims people should fear, calling the decision to allow a LAIV vaccine using a WHO and CDC declared “novel pandemic virus” an “arbitrary and capricious decision without any basis in the scientific record.”
Citing HHS Secretary Sebelius’s September 15th testimony before a Congressional committee when she announced the vaccine licensing, that even the FDA’s own scientists would not “sign-off” on the use of the most toxic vaccine ingredients (known as “oil in water adjuvants”) the Plaintiffs allege the government has a plan to nonetheless approve these substances, never before approved for drug use in the United States, under an “Emergency Use Authorization” (EUA) permitted by the 2005 Project Bioshield Act. On July 13, 2009, according to a press release on the www.HHS.gov web site, the government purchased nearly a half billion dollar’s worth ($485 Million USD) of the deadly adjuvnt squalene, an oil in water adjuvant, blamed by many nongovernmental physicians as a “Gulf War Syndrome” causative agent in more than 25% of the soldiers who were subjected to an experimental anthrax vaccine, Vaccine A, containing squalene. Vaccine A was later authorized under an EUA propmpting a Court ruling that makes its use legal only in voluntary situations. The government’s stockpile is enough squalene to “stretch” the 167 million doses of “Swine Flu” vaccine the government has purchased to cover the entire American population since the purpose of an adjuvant is to increase immune response to the injected material. The FDA web site indicates that the adjuvanted vaccines will be provided under an EUA which will allow the agency to skirt “Good Manufacturing Practices” and any issue of whether squalene is too dangerous to be permitted.
Secretary Sebelius further testified before Congress that a single company will be contracted by the government to deliver the vaccines to 90,000 locations around the country. The FDA site further indicates that the squalene will be mixed with the approved vaccines at those sites before administering the shots, without regard to normal pharmaceutical manufacturing requirements. The Plaintiffs claim that this will result in dangerously adulterated vaccines that may cause much more injury than the infamous 1976 “Swine Flu” vaccine program that killed hundreds and maimed thousands before it was stopped just ten weeks after it began, with nearly fifty million Americans having received that deadly shot or the dangerous squalene-adjuvanted Vaccine A which caused so many cataclysmic illnesses and deaths in Gulf War I military personnel. These shots, too, were both unnecessary and untested.
In their submitted Complaint, Brief and Certifications the Plaintiffs remind the Court that as early as 1905, even before the Federal authorities had the legal power to license vaccines, the Supreme Court stated, in Jacobson v Massachusetts (197 U.S. 11),
“We are not to be understood as holding … that the judiciary would not be competent to interfere and protect the health and life of the individual … ‘All laws,’ this court has said, ‘should receive a sensible construction. General terms should be so limited in their application as not to lead to injustice, oppression or absurd consequence.’ …”
The lead attorney for the Plaintiffs, Leslie Fourton JD, of New York, is working with the respected Washington regulatory law firm of Swankin and Turner and a team of legal experts from around the country, including Larry Becraft JD, Alabama, Alan G. Phillips JD, North Carolina, and Ralph Fucetola JD, New Jersey.
Counsel Fourton stated,
“Without taking into account serious objections raised by many scientists, FDA approved four “Swine Flu” 2009-H1N1-A Vaccines without enough concern about any definitive safety testing and the quality thereof. The Secretary of Health and Human Services testified before Congress, announcing the approvals and a program to widely distribute the Vaccines which were purchased by the federal government. The administrative record appears to be defective in that the record as posted on the Agency web site does not include, for all the approved Vaccines, a drug package insert or label with an accurate list of ingredients. We don’t know what was approved or how dangerous it may be. The Plaintiffs seek immediate relief.”

Despite the FDA’s intention to begin delivery this week of what they describe as the novel “Swine Flu” 2009-H1N1-A live virus nasal mist vaccine to 90,000 government-approved locations nationwide, six New Yorkers, including Natural Solutions Foundation’s Medical Director, Rima E. Laibow, MD, and several NonGovernmental Organizations (NGOs) filed for an Emergency Injunction in the US District Court for the District of Columbia to prevent the distribution of what they believe are illegal, unnecessary and dangerous vaccines.
The case of Null et al. v FDA et al. [Docket No. expected Friday, October 9, 2009] challenges the legality of the September 15th, 2009 licensing of four vaccines prior to any safety testing for what the government calls a “novel flu virus with pandemic potential.” Although the government states that none of the vaccines contain adjuvants, that is manifestly untrue since the injected vaccines contain aluminum, a toxic adjuvant, and Novartis told the Natural Solutions Foundation on that same day that their approved vaccine contains MF59, their proprietary squalen adjuvant. The purpose of an adjuvant is to irritate the immune system into greater production of antibodies than it would otherwise create in response to a smaller antigen dose. Antigens are the most costly part of a vaccine to manufacture. Therefore, despite the enormous dangers, vaccine manufacturers are eager to use adjuvants.
Adjuvants like squalene (also known as MF59, ASO 1, 2, 3 and 4) are highly toxic unapproved drugs in the US. The Novartis (approved) Swine Flu and GSK (awaiting approval) vaccines contain 1 million times more oil in water adjuvant (read, “squalene”) than the devastatingly dangerous Vaccine A which caused the profound illness and death of so many previously healthy service men and women.
Why so much squalene? Read on.
A pair of patents filed in 1998 provide a means of turning the immune system of anyone receiving an injection of squalene at high doses plus a pig glycoprotein (very similar to the many biologically active human glycoproteins we all have) against the reproductive capacity of that person. That means that all of the children and pregnant women who are the first guinea pigs for these vaccines around the world could be rendered permanantly and irreversibly infertile through these shots.
Perhaps this helps to explain the mystery of why the US government would invest almost half a billion dollars ($485M) to stock pile a dangerous, untested and unapproved injectable version of squalene. The rest of the mystery, of course, is solved when you recall that the FDA has said on its site that the squalene will be added to (“admixed”) with the vaccines administered at the 90,000 sites to which they will be sent for injection.
Natural Solutions Foundation Seeks Delay in Vaccine Use Until Legally Required Safety Testing Has Been Completed
Although safety testing of all vaccines is inadequate, as shown by the high levels of side effects, adverse events and damage caused by vaccines, especially influenza vaccines [and most especially, live attenuated influenza virus or LAIV vaccines], even that safety testing has been eliminated by the FDA. The government says that the H1N1 virus is so novel that they classify it as a bioweapon.
Yet they say that there is no need to test the vaccines, adjuvanted, LAIV or not, because their manufacture was accomplished by the same means that other influenza vaccines are made.
While this would not mean the vaccines should not be tested, the manufacturers themselves give the lie to this rationalization for imperalling all of us: Novartis and Baxter claims that their approved vaccine is, in fact, manufactured in a novel manner. It is so novel, in fact, that we have previously written about the dangers of vaccines cultured in monkey kidney cells which are infected with, among other stealth viruses, SMV40, a known cause of leukemia and other soft tissue cancers responsible for the leukemia epidemic which has impacted so many recipients of the polio vaccines. There is no assurance whatsoever that this danger, and others similar to it, has been eliminated from these vaccines.
Yet FDA races to approve them before their dangers CAN be documented in order to protect the manufacturers – and itslef! – from loosing their protection from all litigation and liability UNLESS they act in willful negligence.
Any court in the land would find that if they completed the safety tests, saw the dangers of the vaccines and continued to use them, they would be acting in willful negilgence and then all sorts of fiscal hell would break loose. So it is imperative that they reap their astonishing financial windfalls and sow their deadly whirlwinds BEFORE any safety testing is completed.
Nasal spray vaccines, which are LAIV vaccines, according to their manufacturer, Medimmune, while not adjuvanted, work by producing the very illness they are supposedly designed to prevent (it’s not a case of the flu since it was not “acquired in the community”, but it has the identical symptoms. Of course, we say, “If it coughs like a Swine, Flies like a Swine, has muscle aches like a Swine, it must be the Swine that Flu”, right?)
That means, of course, that the government, in collusion with WHO and the depopulationists, have every intention of unleasing a pandemic. Once the virus is well established, it is free to reassort, mutate, recombine and undergo changes that could turn it from a trivial infection which requires, despite all the hype, no treatment and is actually milder than the regular seasonal flu, into something truly fearsome. At that point, if it happens, several things will happen: First, we believe that mandatory vaccination, now permitted under emergency powers at the State and Federal levels, will be invoked, with vaccine refusal criminalized and punished by misdemenor or felony status, fines and incarceration/involuntary quarantine.
Second, vaccine refusers who do not allow their children to be vaccinated will either see them forcibly vaccinated against their wishes or removed from their homes. Intrusion teams are already funded by the Federal Government and many States are following suit. FEMA announced a few months back that they had set up special camps to meet the special needs of children.
Third, if people try to protect themselves and their children using physical means to stop the intrustion teams, vaccinations, loss of rights and personal autonomy and indignity of being forced to undergo dangerous proceedures which violate their beliefs and wishes, the spectre of Marshal Law will suddenly become very, very real. Therefore, our best protection is urgent, vigorous action now, not tomorrow.
Our government has, in fact, turned against both our rights and our bodies. In fact, it has turned against our very survival. We still have legal actions available to us and there are, astonishingly, still some judges loyal to the Constitution they have sworn to uphold. There are also some military people loyal to the same document and their loyalty is a factor which may yet save us all, IF the foreign troops quartered on US soil (also forbidden by the Constitution) are not brought to bear upon us in tyrannical ways.
After you read the Complaint and the Brief and some documentation on the dangers of Squalene and similar adjuvants, it’s time to talk about what you can – what we believe we all must – do before the last second of the last minute of the now-past 11th hour has vanished and, with it, our ability to own and control the fate of our own bodies.
1. Are you a Pharma Serf? Is your body owned by Big Pharma and the Corporate State? I did not think so. Neither am I! This new Action Item goes to your State and Federal Legislators, the President of the United States and your Governor telling each of them that you expect them to protect you against vaccinations which are supposedly voluntary but, in reality, carry severe penalties if they are refused.
Please submit this item once for every member of your family and then disseminate, disseminate, disseminate.
Our collective efforts are the only bulwark we have against this madness. Alone we are literally powerless. Together, we have created the push back that has taken us from “All vaccines will be mandatory for the Swine Flu” to “All vaccines will be voluntary for the Swine Flu BUT…..” There is a great deal more we need to do and we are fast running out of time to do it.

We cannot guarantee that we will be successful if we all do all of these things. But we most certainly can guarantee that the result of failing to do our absolute utmost during a time of utmost emergency will result in cataclysmic results.
If we win, the FDA will likely appeal the decision. If we loose, we will most certainly appeal the decision. This is an expensive process. The good news? Our lawyers have been working for very little, we have not paid our experts and we have gotten this far on your donations. The bad news? From here on out, it gets expensive, really expensive. They know that a single angry voter is enough to knock an incumbant out of the primary round of elections and that is your power!

Create the Pandemic
1. The first type of vaccine “ready|” for distribution is a Live Attenuated Influenza Virus (LAIV) vaccine. administered by the nasal route. LAIVs are particularly dangerous both to the person who takes them AND to those around them. These vaccines cause people to shed the virus to others and infect them. The virus is then able to reassort or mutate as the infected persons (who may be too young to have any idea what is happening) go about spreading the virus into a varied community of friends, neighbors, family members, playmates, people on the subway, anyone.
People like young children, pregnant mothers, people on immunosuppressive drugs and others are told that they should avoid the live virus, yet it will be disseminated into those very populations with no controls or protections since pregnant women, children, First Responders, health care professionals and people with chronic diseases will receive this “first wave” of LAIVs.
Cull the Population While You Kill the Next Generation
2. In addition to what we already know about the squalene adjuvant and its ability to cripple and kill through powerful auto immune mechanismswhen injected, there is another, deeply shocking reason that the amount of squalene and squalene derivitives (called MF59, AS01, AS02, AS03, AS04, MLP, etc.) to be used in the coming mass vaccination is so insanely high when just a few molecules in the injection can wreak lifeling havoc.
A patent was filed in 1998 for a vaccine which causes permanent infertility when injected. When combined, the materials which cause sterility are a highly active immune irritant (an adjuvant) like squalene in very high doses and a porcine (pig) glycoprotein. Put them together in an injection and not only do you have auto immune consequences like death, or for those who do not die, crippling rheumatoid arthritis, Lou Gehrig’s Disease, destruction of the muscles, diabetes, disabling rashes, mental and neurological problems a-plenty, but you have a population of infertile men women and children.
Americans are not going to take it any more. Even most healthcare workers, including doctors, refuse to take voluntary vaccines.
We’ve spent some time on the phone with both the pro se Federal Court plaintiff in New Jersey (whose application for injunction was denied this past Monday and the State Court pro se plaintiff challenging Florida’s draconian forced treatment law (she survived the State’s initial demand that the Judge dismiss the case; has 60 days to file a full brief). Several patriot, pro bono attorneys have privately discussed the legal requirements for injunctive relief with them and others seeking relief. As one trained in the law, I applaud the efforts of pro-se litigants to assert their rights in court.
On behalf of the Foundation, we are also actively communicating with a group of patriot lawyers around the country seeking ways to help people pursue legal actions to Stop the Shot.
Several strong actions are being planned in NY state on behalf of the healthcare workers by lawyers who represent vaccine injured people and people seeking to assert vaccination exemptions. We hear rumors of actions conteplated in Washington State and California. The Foundation and its allies have filed an action in the DC District Court (see story above). Efforts to bring complaints before civil rights and similar bodies are being explored.

The same authorities who have warned us about the potential for pandemic for monthsnow begin to change their tune, since it’s clear we don’t buy their obscurations and since we have (and we are!) independent sources of news, on the Internet, over Radio and the like, where people have learned not to trust authority.
“The World Health Organization, the UN agency (ir-) responsible for declaring a Phase 6 “PANDEMIC” global alert over what it calls H1N1 Influenza A or Swine Flu, whose chief Dr Margaret Chan has repeatedly warned that while Swine Flu to date had been rather mild, that the emergency declaration was necessary because it “could mutate” aggressively into a deadly pandemic killing millions, now admits well into the flu season in the Northern Hemisphere that H1N1 has apparently not mutated.”
So New York’s “emergency” flu vaccine mandates are based on no emergency; the HHS’s April 25th declaration of “emergency” with its language exculpating all government officials from the harm that may occur is based on no emergency; the imminent Emergency Use Authorization that will permit the use of “adjuvants” (immune system toxins) that have never been permitted in drugs in the United States, because the government’s own scientists will not sign off on them, will be based on no emergency.

OK. Now for the tough stuff
The article below details the horrific reality that I wish were not true. The Natural Solutions Foundation has been saying for quite some time that we see clear evidence of a genocidal intention in the overblown, clearly intentional Swine Flu “Pandemic”. When WHO moved the “Pandemic” from Level 4 to Level 5 the disease was so mild and inconsequential that they literally had to change the definition of a Pandemic at Level 5, leaving out the words “with the ability to cause serious illness and death” from the definition because it did not and could not. We believe that this must have been a great disappointment to the folks at the WHO who have been both predicting and involved with genetically engineering one failed pandemic after another. But WHO, you will remember, believes in a “sustainable planet” and that sustainability (favor them, not us, of course) means that they believe, too, that 90% of the world’s population needs to die.

They do not much care how we die as long as we do it on demand and they manage to squeeze out a good dollop of profit as we do so. Some of us, however, will die because we are never born. That, too, is part of the genocidal plan. You may recall that we reported some time back that we had seen official WHO documents from 1985 stating that the real purpose of the current vaccination program taking place in Africa at that time was not disease control (they know perfectly well that vaccines are hokum, without a shred of valid scientific evidence behind them) or prevention, but the dissemination of materials which cause infertility in the women into whom it is injected. At that time, they were using vaccines with strong response patterns laced with Human Chorionic Gonadotrophin (HCG), a reproductive hormone (a glycoprotein, by the way – that figures into this true horror story a little later on). When you train the immune system through injecting it with adjuvants to “break tolerance” or attack the molecules as “not me” that it normally recognizes as “me”, if you prime it properly, you can create an immune intolerance to the hormones or other molecules of your own body.
In this case, and the same system has been used against untold millions (billions?) of women in many third world countries all over the world, the body attacks every molecule of HCG it encounters after that. The problem is that without HCG, the uterus cannot retain the embryo, or the fetus and it will expel the future baby if she were pregnant at the time of the injection. If she were not pregnant, she will never again become a mother. Her body now destroys the very hormone without which she cannot sustain a pregnancy. This damage is irreversible.
But not universal. Apparently, that is the problem: there are still a few people whose immune response is not sufficient to destroy all of their fertility. So now we move, in the march of mad science, propelled by forces of such deep inhumanity that it is difficulty to confront them with clear, calm eyes, to another infertility system.
In 1998 a Patent Application was made for a system which uses a person’s own immune system to render them permanently infertile, sterile, unable to have children. The system is irreversible, once injected.
Knowing that:
– Both Novartis and GSK vaccines “against” the trivial Swine Flu both contain 1 million times more squalene than the devastatingly dangerous Vaccine A which crippled and killed so many Gulf War I military personnel (See Squalene: Be Very Afraid Part I, http://www.healthfreedomusa.org/?p=3592)
– Even a few molecules of squalene injected into the body causes it to “break tolerance” and attack the body’s own molecules to which it is now trained for attack, including the body’s own squalene, a vital component of the Central Nervous System (which accounts for the profound and cataclysmic neurological symptoms of squalene injection
– The WHO, UN and US governments agree on the “need” to reduce population to only 10% of its current levels
– When the WHO declared a Level 6 Pandemic on June 11, offical control of the political and health functions of all 194 countries in the WHO passed to that body, per an agreement signed in 2005 which took effect in 2007
– The haste with which this Level 6 Pandemic was declared makes it clear that the agenda was agreed to whether or not the genetically engineered virus did its job
– FDA/CDC has said that the $1/2 billion stock pile of injectable squalene adjuvant which the US Government admitted it was stock piling will be used to add the squalene to the bodies of people receiving the vaccines which do NOT have adjuvants in them at the time of injection
– The patents for a glycoprotein-containing, squalene adjuvanted H1N1 vaccine were filed in 2007 and 2008 by Novartis, Baxter International and GSK despite the fact that the virus did not yet officially exist, there had never been approval of a squalene adjuvanted vaccine and use of squalene in mass vaccines was illegal through the permanent restraining order of Judge Emmett Sullivan and through the fact that squalene was forbidden to even be tested in the US. The investment of billions of dollars into the development of these vaccines for a virus that did not yet exist, using substances which had never been approved for use in vaccines by 3 separate companies, allegedly competitors in the vaccine industry, is worthy of note all by itself
– The most vulnerable members of society, children and pregnant women, will be vaccinated first.
Now you know what the game is. Since the goal is infertility, what better target population could you choose? With one fell swoop of a needle, a whole generation of “useless eaters” is wiped off the map – the next one while this one is too sick to make much trouble and you clean up like the bandit that you are, if, of course, you are Big Pharma and the global genocidalists!
So now we have mandates for “Influenza vaccines” which are designed to roll the “Swine Flu” up under them. Understand clearly that although your State may offer you exemptions for philosophical, religious or medical reasons, there is every liklihood that there will be NO pandemic vaccination exemptions. The way the federal and state regulations are reading right now, that is the situation. The confusers really do want you to feel
– All vaccinations will be voluntary for the pandemic flu. This is true if by voluntary you really mean “under duress and pain of incarceration, fine and imprisonment.”
– Conventional exemptions will hold for the pandemic flu. This is not true. The pandemic vaccine is governed by separate regulations and laws which do not allow for exemptions.
– Parents will be given the choice of whether to vaccinate their children and themselves or not. This is utterly false unless we take back our freedom to make these decisions for ourselves and our children. Experimental medical procedures are never carried out on the most vulnerable and defenseless first, not until now, that is.
As an aside, do you suppose that President Obama’s children will get the same vaccine that yours and mine will? How would we know? How about the President himself, who bravely agreed to wait until near the bottom of the list. How courageous and public spirited. I will be happy to join him below the bottom of the list and, if all of us have any sense at all, we will all do so by making it abundantly clear to our legislators that this WILL not happen. These people need to hear that the deception is broken, like immune tolerance when adjuvants are injected. We want the right to determine what happens to our bodies. Daniel Solis from the Czech Republic has researched the side-effects of the adjuvant, squalene, and discovered it is known to destroy fertility as well as causing other forms of damage.
A patent for a vaccine to impair fertility in animals contains squalene.
The plan to use this fertility-impairing adjuvant in the “swine flu” vaccine against a flu that has so far been far less irksome than the ordinary seasonal flu underscores concerns that this H1N1 mass vaccination programme mandated by WHO with the support of pharma companies such as Baxter is designed primarily to cause death and injury, and so significantly reduce the global population.
Is it any wonder that these “vaccines” are classified as bioweapons by the regulators? ….
Daniel Solis has also made a formal complaint against the head of the Czech Republic’s FDA and the Deputy Health Minister for awarding a contract to Baxter worth 1,5 billion CZK without an open tender. More legal action in the Czech Republic is planned with the aim of getting Baxter’s license to manufacture the “swine flu” vaccine at Bohumil suspended and to make Baxter accountable for the incident at the BioTest lab, which detected the live bird flu virus in vaccine material from Baxter on February 6th. Members of the lab had to be treated preventatively for bird flu and were put in quarantine.
“I have focused on the adjuvants made of monophosforyl lipid A (MPL) MF59TM (containing a polysorbate TweenTM 80) or AS03, AS04 also known as squalene in the proposed vaccines, which are immunosterilant or an immunocontraceptive,” Daniel Solis writes.

Abstract:
A vaccine comprising an antigen derived from a zona pellucida glycoprotein is effective to impair fertility in animals, preferably carnivores. The vaccine can be used as an immunosterilant or an immunocontraceptive.
