Codex as a Science Based Organization –
Or, Fake Science in the Service of Special Interests

I was priviledged, among my commands in the US Army, to serve as the Commanding General of the US Army’s Electronic Research and Development Command (ERADCOM). As the Commanding General of 7 major laboratories, I was very interested in the differences between wish, denial and science. That interest has continued over the years I have been observing, as Natural Solutions Foundation’s President, what passes for science at Codex Alimentarius, the so-called “World Food Code.”
Sitting here in the 33rd Session of the Codex Alimentarius Commission, the decision-making body of the supposedly “Science-Based” organization purporting to set standards which protect consumers’ health around the world, I am struck by several questions pertaining to the quality and depth of the supposed “Science-Based” nature of Codex’s decisions. The strong push of the US and its agents (and its Big Biz backers) to overcome the resistance of the 160 countries (which all ban Ractopamine), forcing the use of Ractopamine in cattle and hogs, turkeys and other animals despite the known dangers of this substance and the unknown ones as well, brings the entire nature of the supposed “Science base” of this dangerous organization into focus. One way Codex seeks to present itself as science-based is with its “expert” committees. Among these is the Joint (FAO/WHO) Expert Committee on Food Additives – JEFCA.
JECFA science is based, in the case of Ractopamine® (the veterinary drug used to fatten pork faster in the US, but banned in China), on misstated science which does not answer urgent questions. First of all, who paid for the study which JECFA conducted on this dangerous drug material? Did they, in fact, conduct either their own studies or a review of the scientific literature? If they had, their recommendation for safe use in animals destined for human consumption could not possibly be “science-based”. The real science on this drug is clear: it is not safe for the use they intend. How much money was provided for this study or series of study and what were the terms of that/those study/studies?
Were JECFA’s findings of safety of Ractopamine based on the fraudulent and defective studies the FDA used to determine that Ractopmaine was “safe”, data which were deemed fraudulent by the FDA itself?
What connections with industry did the persons carrying out the analysis at JECFA have? Are they, as FDA/USDA and other regulators in the US riddled with conflicts of interest? If not, to what standard is their lack of conflict of interest held?
Did the JECFA either study, or review, how Ractopamine is processed in the human body and how it is eliminated from it? What about the build up, and detrimental effects of Ractopamine when ingested, including cardiac symptoms, testicular atrophy and leukemia? How were they able to determine which humans are susceptible or that no wash out period following ingestion by the animals needed to be introduced before slaughter to protect human ingestors?
Did they determine a daily Ractopamine intake in humans free of observed effects? If so, what is it? How much or little of this drug is “safe” for the use in question, bringing pork to market faster?
These questions are, alas, rhetorical because the determination JECFA made that Ractopamine is “safe” is no more “Science-Based” than a belief in the Easter Bunny. The data, which are known, are clear.
Ractopamine is NOT safe for human ingestion or contact. The US FDA may say it is, leading to JECFA to say the same, but that is economically and politically based, not Science-Based. It is a “science excuse” for a policy determination; policy determined for the benefit of special interests, not the general public.
This is, however, not the first time that this same lack of scientific rigor has been publicized as science. An outstanding, and outstandingly dangerous, example is what Codex has done to nutrients.

Codex considers nutrients to be dangerous toxins which have to be limited to “protect” stakeholders. Indeed, since the stakeholders here are the Pharmaceutical interests, they are well protected by treating nutrients as toxins.
Too few nutrients will lead, inevitably, to profitable conditions like cancer, cardiovascular disease, stroke, diabetes and obesity, as the World Health Organization and Food and Agricultural Organization themselves document. Qui bono? Who profits? Big Pharma, Big Medica. Who suffers? Little people all over the world.
Codex now defines itself, in the words of Codex Chair Karen Hulebek just today, as “Risk Managers” . Risk Management, a technique derived from toxicology, should, indeed, be applied to toxins. Increased toxins require increased nutrients.
Many countries laud, believe in and depend upon the idea that Codex is, indeed, “Science-Based”. Yet the “science” which treats nutrients as toxins, down regulating them through mechanisms like the Nutrient Reference Values (NRVs) which guarantee under-nutrition for the teeming billions of the earth, and equally guarantee their disease, infertility and death.
That is not science, unless it is the pseudo-science of eugenics!
Under US law, nutrients are foods. Under US law, nutrients may NOT be “HARMonized” with Codex standards. Yet the US pushes both at Codex and in the US regulatory context, for controls and limitations on nutrients, despite our legal standards and protections.
Poor health is supported and maintained by poor nutrition. That is the biochemical and physiological reality. Nutrients are necessary in high levels to combat poor health, poor development, shortened life spans and preventable human misery. Take them away and the results are totally predictable.
Under Codex/WHO/FAO plans, every country will have a Nutrient Risk Manager to make sure that high potency nutrients never get near their population. `And who pushes this nutritional holocaust hardest? The United States Codex delegation.
To my mind, the logical response to this out-of-control and illegal regulatory stance both in the US and in Codex is to remove the US from Codex, which adds little or nothing to our nutritional and health status. The US, like every other country, can raise the standard of its food above Codex standards without World Trade Organization penalty if they follow the Codex Two Step Process.
Getting the US out of Codex, where its dangerous policies are damaging food around the world, and at home (since Codex standards are imposed over US law) is a logical, workable and necessary response to the genocidal and non-science-based actions of the US in Codex and Codex itself.
Gen. Bert and Dr. Rima are attending the Codex Commission meeting in Geneva, Switzerland, acting as your eyes and ears. As we often do, Dr. Rima, Gen. Bert and I are “chatting” notes to each other about the event, as it happens. Below are some notes I’ve taken off the chat that give you the flavor of the meeting…. and an explanation of that “Codex Apple”.
One incident sums the situation: The US delegate proudly referred to Independence Day inviting all present to celebrate the USA’s Red White and Blue with — yes…, Red, White and Blue chocolate bits left at each delegations table. The other delegates looked on with disdain, since they have their own Independence Days and many of their flags feature the same colors. The response was an “arched brow” suggesting that the Americans are naive at best thinking that chocolate bribes are all that’s needed for the US global agenda to succeed!

The apple suggests wholesome food. Nothing could be further from the truth. As if to underscore the destruction of the world’s food supply, the 33rd Meeting of the Codex Alimentarius Commission, July 5-9, 2010 (Geneva, Switzerland) approved a standard for apples which permits not more than 5% of the apples to be composed of FEEDING INSECTS!
When India and other countries protested that this unprecedented approval of filth as “food” would lead to poor quality and inedible food being dumped in the poorest nations, the Secretariat clarified that this standard permits FEEDING insects, not PEST insects. Despite the strong protest expressed by numerous countries, large and small, the US, EU, Argentina, Brazil, Australia and New Zealand, the countries least likely to wind up with these insects on their dinner plates, bulled their approval through with the complicity of the Codex Commission Chairperson, the US’s Karen Hullebeck.
Everything else done by this Codex session continues to degrade the world’s food supply despite the continuing, but continually ignored, protests of the developing world.

Columbia: Although we are not here to have academic debate, we would like to express concern. In addition to live pests (not quarantine pests) we would like them in the standard, If this were approved, we want to note that this is the first time that a pest was ever included in a standard!
China: Chinese delegation supports interventions by Thailand, Philippines and Malaysia.
Malaysia: shares the concerns expressed by China.

Egypt: It is enzyme statements. Pest infested fruit will be dumped on poor countries.

Mexico, US, Canada, Chile, Brazil rise to support– to honor the work of the committee.
Chair: as we understand the comments that have been made, which are variations on a theme, we want to ask the commission that a provision applied to an earlier text and previously proposed by Thailand could be added to this text as a footnote with the provision that it be considered.
Proposal: Add to standard footnote: re pest issues: “This provision applied without prejudice to the applicable plant protection rules.”
Columbia: Thank you, madam chair: despite the footnote provision, Columbia wishes to express its reservations.
Thailand: can accept adoption with our reservations, hoping that the market can be as good as the apple on the flag!
India accepts the provision suggested by Thailand, and regarding tolerances, please accept our reservations.
Chair: will record reservations of Columbia, Thailand and India and adopt this footnote.
Egypt: we support the comments by India and Thailand and approve your proposal. We request that our reservations are included in report and we support proposal.

Argentina: would like to include parasites in introduction and take out paragraph that mentions pre-cut.
Columbia: Editorial observations, but over and above that, would like to voice reservations over tests in humans when it comes to organic fertilizers because that is what is covered. We recognize risks with control to human pathogens.
US: Chair of committee on Food hygiene: His comments on how to proceed. It is not specific to human feces, but the term used is human waste.
Parasite is giradia lamblia, but the intervention concerning a change of the scope of the document to restrict to pre-cut cannot be done.
Columbia: We are not sure if we leave human waste in if we are leaving it implicit that this would include feces. Our fundamental observations is whether it includes human faces are used.

[10:02:01 AM] Rima Laibow, MD: The Ractopamine fight continues: Ractopamine is a dangerous drug used ONLY to make animals grow fast. They have been fighting over it for a long time. China (largest producer and consumer of pig) says that it should be banned. The US never wants dangerous toxins banned!
Rwanda: Ractopamine levels: ADI levels for acceptable levels. Only the lungs pose an issue. This is a specific matter for China.
MRLs [REL – “Minimum Risk Level”] residue levels in the lungs are for study at another time. Kidneys and liver levels are OK.
Nepal: Nepal supports Ractopamine standard.
Japan: MRLs exist for Ractopamine based on ADI. Discussion made so far.
Jecfa examined levels in kidney and lung, found that estimated daily intake is higher than ADI. Lung had highest concentration, therefore lung shoud be the target tissue.
When residue level in target tissue is higher than ADL. China imported 100 tons (?) of animal offal last year from US.
Chinese delegation is against adoption of RACX and we hope that you will reject this standard.
Zambia “I think we have to look at the issues of food safety here” Zambia wishes to have this standard adopted.
Mexico would like to have maximum amounts approved.
India: We see major gap in the analysis. I do not know how you can take a holistic view of the body when you have no data. I do not think we can approve this standard.
JECFA showed that ractopamine was quite toxic. Based on the data provided including the information from China, from the China. Different offal tissues were used,. Very few people reported that they consumed lung tissue.
This is a matter for national issues, not international adoption of standards. [REL – again, the recognition of member state sovereignty]
Chair: This level has been finalized and we are NOT going to revisit
Uganda has a pig population of about 3 million. We recommend and support adoption of levels for Ractopamine.
France is not getting translation.
EU AGAINST THE USE OF DRUGS ON HEALTHY ANIMALS BASED SOLELY ON AN ECONOMIC REASON.
We have a second series of arguments based on science. There is a serious problem with things like BSE from the 1990s. There are a series of doubts which remain.
Excellence, transparency and independence are the most important issues here. We are in a setting where there is undermined credibility of Codex. Should be referred to JECFA
Canada: JECFA’s report was conducted at the last CAC. The conclusion of this report led to these levels. Canada sees no reason to hold this standard at Step 8. Despite the report by JECFA, we are sensitive to the issues proposed by China: the standards discussed by JECFA should be adopted for the tissues studied, but that these tissues do not include lung.
Norway opposed adoption based on human and animal health. Veterinary drugs should only be used to treat diseases. It is not necessary or acceptable to cause abnormal growth using Ractopamine. There are still so many uncertainties about health so we think that all necessary studies must be done before Codex adopts these standards.
We think that the CC on Veterinary Residues should look at this further.
Tonga: we should approve the standard, but with the proviso that we can open it again.
Saudi Arabia: we have much trust in all the procedures that are carried out by the Codex. Since JECFA has taken upp all necessary procedures, we support the adoption of this standard but this does not prevent us from taking it up again on the basis of new information. (THEY HAVE NO PIGS! – KILL THE INFIDELS!)
Singapore: we respect JECFA adn China. JECFA did not take all tissues into consideration. Exposure through the consumption of offals cannot be ruled out. Draft recommendation for kidneys, livers, lungs, should be deferred.
South Africa: I recall our meeting in 2008 when this matter was put forward. On account of new information we agreed to defer, we did the same last year. One of the questions this debate brings forward is whether we rely on scientific information received from JECFA.
Science is never static, but that should not detract us based on a body of evidence based on this information and we should adopt it, but we should not be shy to call into questions our decision based on new information. We support the approval of the MRLs.
Chair: we have been discussing this issue now for about an hour. We could continue to hear interventions and that would take some time. It is always worth listening to each other but I would like to ask you to consider whether, given what you have heard, with a number of countries speaking in adoption, some countries speaking out in a combination of partial adoption and other countries opposing, it would seem to be difficult to say that there is consensus. I cannot see, based on what I have heard so far, that we are likely to find one in this room. So what I would suggest to you, and ask if you can agree to this proposal , is that given the degree of interest and involvement that there appears to be a will to continue to look for a solution, but given that we cannot do it in plenary, but could we agree to taking no more interventions today, but to work together to try to find a solution to satisfy the concerns of those who oppose them which serves the needs of Codex and moves it forward.
Those interested parties should work with each other, talk with each other and try to come to an agreement and report to this body at 4 PM tomorrow. Keep in mind we have only 3 working days.
We clearly do n ot want to wait until the last moment to take this up.
Brazil: we understand that this has been extensively studied by JECFA. Canada has proposed a solution for those countries who want it approved and for China which has objections.
Chair: I thank you Brazil, but I do not think that Canada’s suggestion will satisfy. As soon as Canada proposed it, another country opposed. Thank you for trying, Brazil.

Switzerland, are you opposing? We are not opposing, we are just wondering about the feasibility since most of us will be here in plenary and then come back to plenary with a solution.
We realize that the issues at hand are quite complex and we really doubt that we will be able to come up with a solution by 4 pm.

What Does Attending a Codex Session Mean for Dr. Rima, Gen. Bert and YOU?
Your generosity and support sends Natural Solutions Foundation to a variety of Codex meetings around the world. Right now General Bert and I are in Geneva Switzerland. We left our home at the Valley of the Moon Eco Demonstration Project in Volcan, Panama, www.NaturalSolutionsFoundation.org, to get on a plane to Panama City, then another one to Madrid and another one to Genva two days ago so that by the time we reached Switzerland we had not slept for about 48 hours. Why didn’t we take a quicker, more direct route? Because neither General Stubblebine nor I am willing to expose our bodies to the radiation hazard of full body scanners and neither Madrid nor Geneva airports use full body scanners.
We got to Geneva and continued our preparation for the meeting. You see, in order bring you intelligent, meaningful and precise information in our daily video and written reports and later create meaningful strategies to deal with Codex and its dangers, we need to do a major amount of planning and preparation.
Codex is designed to be overwhelmingly complex, detail driven and difficult to comprehend because the technical level of the considerations is so enormously demanding if you are going to understand it all. Delegates are just supposed to be so overwhelmed that they simply sink into a lulled position in which whatever the US or EU says is what they go along with, sort of like the courtiers just letting the red queen do what she likes in Alice and Wonderland because it is so much easier and safer.
But at Codex, as in so many other urgently important situations, the devil really IS in the details. Consider:
There are 15 Committee Reports to be studied from major codex Committees (http://www.codexalimentarius.net/web/archives.jsp) for the Codex Alimentarius Commission (CAC) session starting on Monday, July 5.
The Report of the Codex Executive Committee has 28 pages
The Committee on Food Labeling has 58 pages
The Committee on Contaminants in Foods has 69 pages
and so on through the 15 committees presenting their items for discussion at the CAC.
Potentially buried in each one of the clauses, phrases, reports and agenda items is a time bomb that can, despite its innocuous language, kill people through the implications and permissions granted via its legalese.
Nutrient Reference Values (NRVs) and GMO labeling are excellent, but by no means unique, examples. Both of these issues are highly technical and both, if carried out as the US desires, would lead to highly undesirable outcomes. NRVs are daily intake values of nutrients so low that they actually introduce and make permanent, the under-nutrition which WHO and FAO point out as the primary cause of the non-communicable, preventable, degenerative killer diseases: cancer, cardiovascular disease, stroke, diabetes and obesity. Misleading consumers into believing that their processed food provides adequate levels of vital nutrients, the NRVs are both a biochemical absurdity and an atrocity since they will, through their use on labels, lead people to believe that since their food is providing most or all of the NRVs, it provides the nutrients they need for a healthy life.
NRVs have been winding their way through the Codex Committee on Nutrition and Foods for Special Dietary Uses (CCNFSDU) and the Committee on Food Labeling (CCFL). When South Africa was discussing them in 2005 at CCNFSDU, Dr. Grossklaus, the Chairman cut the delegate off at the knees when she mentioned “optimal nutrition” and said “It would be nice if Codex were about nutrition, but it isn’t. It’s about trade!” But most delegates have no idea what biochemical individuality is about, why high potency nutrients save lives, money and misery and the discussions must include the technical issues of the Codex texts and committee which are dealing with NRVs, their status in the CAC, etc. To learn more about where this nutrients as toxins, nutrients as controlled substances, idea in Codex, click here to watch “Nutricide”: http://video.google.com/videoplay?docid=-5266884912495233634#.
GMO labeling is another example, as is whether Codex should define consensus or a code of ethics for codex participants. In these discussions and decisions, information lies which could, going in one direction, change history and survival for good and, going in the other direction, could do exactly the opposite.
Each Agenda Item rests on a multi-year background with a huge pile of data and debate behind it. Having that perspective is essential to informed, effective dialogue with the delegates at Codex and in their home countries. And that is what we do at Codex! We take your interests, and those of well-nourished, autonomous, food independent people and “bang them against” what Codex is doing. The lives of food producers, food consumers and the planet turn on these tiny nuances since all of the Codex documents are written in such a way as to lull you into a fluorided haze of complacency. There is, however, nothing to be complacent about.
There is also nothing worth participating in at Codex. It is my contention that the United States needs to get out of Codex and do it now. We will lose nothing and grain a great deal, I believe, by loosening the hold that we have allowed the World Trade Organization, WHO, to place on us through trade agreements that can only inevitably degrade our food and our health unless we follow the Codex Two Step Process, as other nations have done successfully. If we were out of Codex, I believe that two things would happen:
First, it would be a great deal easier for interested parties to apply pressure to force the US to deviate from the Codex guidelines and standards since we would not have teams of experts ramming these guidelines and standards through Codex and, second, we would not be twisting and distorting the entire Codex process, making the decisions that the US wants, not the ones that protect the farmers, the consumers and the earth. By the way, the Developed World is one of the major consumers of third world-produced toxic food. Here is the link to my video:
There are at least a hundred equally vital items before the CAC this week. They would be far better decided by the national competencies of the countries rather than by the “bully of the class” threatening the other kids in the class with the active and vigorous help of the corrupt and self interested “teacher”, WHO, a corrupt and genocidal organization which acknowledges that it wants to see the population of the earth reduced by a minimum of 80%, better 90%!
So what we do is prepare for the topics of greatest interest to you and to the developing world’s delegates, mingle with delegates and share our perspectives on these topics and provide leadership for dissent strategies. Then, very importantly, we offer them information on how they can increase crop yield, decrease food born illness, and, in reality, actually accomplish exactly what Codex says it is about.
And we report. After each day’s meetings, we make sure that you know what the highlights (and low points) of the day’s proceedings have been, what they mean for you, what they mean for the dangerous forward movement of “HARMonization” by the US and how to protect ourselves, our health and our health freedom.
Attending Codex is really hard work. We do it for you, with your support because it is hugely important. At the end of a Codex meeting we are exhausted. Then we fly home to Panama to put the things we are teaching the developing world into practice.

GMO CASE DECIDED FOR CONSUMERS, ORGANIC FARMERS. MONSANTO SAYS NO, THEY WON. THE TRUTH IS THAT PUSH BACK WORKS, AND WORKS AND WORKS BECAUSE YOU, THE HEALTH FREEDOM NET ROOTS, WORK AND WORK AND WORK!
The US Supreme Court gave us a tremendous win by making it clear, as the article below shows, that consumers – that’s us – have the right to sue corporations and government agencies to stop poor regulations from going into effect.
That’s exactly what the Natural Solutions Foundation is doing in our Stop the Shot case against the FDA and in our Ear Candling case against the same corrupt, multinational-corporation-controlled FDA.
In the first case, we are now preparing to file for the third time. Each of the first two times that we filed this case which says that US law clearly and unambiguously says that vaccines must be tested and shown to be BOTH safe and effective before they can be released to the public. No flu vaccine has passed those two tests. For that matter, no vaccine has passed those tests.
But the FDA continues to support the use of more, and more toxic, vaccines for children and adults in the absence of a single shred of evidence that vaccines work or are safe.
Each time we filed the Stop the Shot case, the standing of the plaintiffs (us) was undermined when the agency which was meancing our defendants with job loss or worse backed off on the eve of the trial going forward. Both times the judge said, “Well, you’ve won!” and sent us out of the Court House to go celebrate. But that was not the win we were looking for. We don’t just want the corrupt Department of Health Commissioner in New York State and the Governor to back down, we want all influenza vaccine banned. The next time, it was the mandate for all children under 5 in New Jersey to be vaccinated before they could be enrolled in a state-licensed day care center.
That is not what we are looking for although we congratulate the parents of young New Jersey children on having that mandate lifted.
We want a full and total ban on vaccines which have not been tested to prove their safety OR their effectiveness, as required by US law. That means that ALL influenza vaccines (and all other vaccines, but our standing is for influenza vaccine complaints right now) are, in fact, illegal, untested drugs in the US! That includes the absurd and dangerous H1N1 vaccines.
Yesterday, the FDA called the Natural Solutions Foundation asking us to withdraw our Citizens Petition about the dangers and illegality of the H1N1 vaccines! Why? Well, perhaps because about 5 months ago, just after a health emergency had been declared, they told us they would respond to us within 6 months since they were too busy to respond to our emergency petition [sic!] and the 6 months is almost up. Now they have to deal with us and they would clearly rather not. So the FDA appears to be asking us NOT to go forward with our campaign to get dangerous vaccines off the market and out of our bodies. That seems to us the very best indication that we are definitely on the right track.
What does that have to do with GMOs? Everything. First, the principle of the Uber-Cartel. The companies which make genetically modified organisms (GMOs) do so to make sure that they tolerate and/or require very high levels of the highly profitable and enormously toxic herbicides and pesticides which destroy the balance of nature and create sick plants and super weeds and pests, requiring yet more of the toxic chemicals. In fact, when GMO crops are planted, the average use of toxic agrochemicals increases by 400% or more.
Of course, these toxin chemicals, such as the new generation of Monsanto’s Roundup(c), containing 70% Agent Orange [dioxin] get into your body, the environment and, tragically, the unprotected bodies of the unsuspecting farm workers whose cancers, infertility, fetal and infant death mimic those of the general population which eats these foods. Codex Alimentarious, the International Food Code, habitually sets permissible limits for foods so high that any limitation is meaningless.
When eaten, these toxic, genetically altered foods literally change the DNA of every cell of the eater – you – and any children that are in the womb or that come after you will also have permanently altered DNA. And so will the plants and animals whose DNA is contaminated by the contaminated DNA of these dangerous foods.
Cancer, permanent genetic alteration, decreased immune function, infertility, sterility, fetal and infant death, auto immune disease, gut, kidney and other organ damage are the rule in every study NOT sponsored by industry which looks at GMO ingestion. But the FDA and USDA do not, and, in fact, MAY not examine the safety or dangers of these patented organisms.
More than 90% of US food is now either genetically modified or contains ingredients derived from GMOs or both.
When you get sick, the very same companies that made money from the sale of the GMOs which required increasing amounts of toxic chemicals to grow AND manufactured and marketed the toxic chemicals are the companies that make the drugs that you are supposed to take when you get sick from their GMOs and toxic chemicals.
The model is circular. The effect is disastrous. That cycle of profit and death is what I call the “Uber-Cartel”.
We all understand that GMOs are untested and that they hide within our food supply since they MAY NOT be labeled, thanks to the every industry-friendly, corrupt and dangerous FDA. We all also understand that the manufacturer of 95% of the genetically modified seed and animal stock in the world, Monsanto, is as ruthless as any corporation in the world in contaminating farmers’ fields, controlling markets regardless of the tragic consequences of such control (e.g., starvation, farmers being driven off their land, increased cancer, infertility, deaths, starvation, crop failure, etc.).
Alfalfa is the 4th largest crop grown in the US after corn (almost entirely GMO in the US), soy (nearly all GMO) and wheat (emerging as a GMO crop now that Japan and other countries have dropped their ban on US wheat if GMO varieties were developed). Fed to cows, organic alfalfa is essential or organic dairy and beef production. It is also impossible to produce organic alfalfa if GMO alfalfa is grown anywhere in the area because of short and long distance contamination.
The USDA approved alfalfa for general planting and use with the usual lack of caution or sense. But this time, when they did so in the absence of the required Environmental Impact Statement, the Center for Food Safety sued. A lower court found that the approval of Roundup Ready(C) alfalfa seeds in the absence of the necessary studies was legal and Monsanto announced victory. But push back is a funny thing: dedicated people and groups are willing to fight the long fight, slog the long slog, to make sure that the right thing is done, that lawful outcomes are the result. The District Court ruled that the planing could not go forward and the case was appealed.
The Supreme Court ruled recently on the case and both Monsanto and the Center for Food Safety declared victory, Monsanto because the total ban on planing GMO alfalfa was reversed and the Center for Food Safety because the Supreme Court did not disagree that the USDA had mistakenly approved GMO alfalfa prematurely AND, even ore importantly, because the Supreme Court, for the first time, affirmed the concept that has also now ruled for the very first time ‘that “environmental harm” includes economic effects such as reduced agricultural yield or loss of market due to genetic contamination, as well as the concept of what biologists refer to as “gene flow” (in practice, the idea that genetically engineered material may get into conventional plants through cross-pollination). The Supreme Court now accepts that this phenomenon in and of itself is harmful and illegal under current environment protections.’
As Michael Hansen of Consumer’s Union says, “That’s a huge win for our side … That’s gigantic!” Future lawsuits can now confidently use the gene-flow argument against approval and use of genetically engineered crops.
So although Monsanto is focusing on the reversal of the total ban of GMO alfalfa, we, the People of the PushBack, see it differently. We see that litigation is essential to this health freedom process we are engaged in and that it can be a very powerful strategy.
That is why our Ear Candle suit, to prevent the FDA from declaring any and everything they do not like as an unapproved medical drug or device, whether it is or not, and demanding that it be removed from the market immediately, and our Stop the Shot case, to prevent illegal, untested, unnecessary, unsafe and uninsurable influenza vaccines from being deployed are so important.

Supreme Court’s ruling on Monsanto’s GE alfalfa: Who won?

The sustainable agriculture world is abuzz today with news of the Supreme Court’s ruling regarding an earlier lawsuit, brought by alfalfa farmers, that sought to stop any planting of Monsanto’s genetically engineered Roundup Ready alfalfa seed. While the press coverage heralds the ruling as a decisive victory for Monsanto, a close reading shows that, in fact, it’s a fairly significant win for opponents of biotech crops.
Hay dudes, not so fast
The background: As the fourth most-planted U.S. crop behind corn, soybeans, and wheat, alfalfa is worth $9 billion a year — the dairy industry is the biggest consumer — with annual seed sales valued at $63 million, according to a USDA study. Monsanto’s Roundup Ready alfalfa seed has been genetically engineered to be tolerant of glyphosate, the active ingredient of Monsanto’s herbicide Roundup.
Earlier this year, the U.S. District Court in San Francisco found that the USDA had illegally approved Roundup Ready alfalfa for planting — which the agency refers to as “deregulating” — by allowing Monsanto to sell and farmers to plant the seeds without the USDA completing a required full Environmental Impact Statement. (A preliminary one was under way.)
In response to a lawsuit filed by GMO-opposed alfalfa farmers along with the Center for Food Safety on behalf of consumers, the District Court halted all planting of Roundup Ready alfalfa until the USDA completes the EIS, which could take years. It also issued two injunctions: one that prevented the USDA from performing a so-called “partial deregulation” of Roundup Ready alfalfa, i.e. allowing restricted and otherwise limited planting, while it prepared the final environmental statement; the other stopping farmers from planting any Roundup Ready alfalfa starting with the 2010 crop year. (For a deeper look into the lead-up to the case, read Matt Jenkins’ excellent 2007 feature “Brave New Hay” from High Country News.)
Today, in a 7-1 opinion written by Justice Samuel Alito, the Supreme Court reversed both District Court injunctions, saying that the Court had overreached itself procedurally in halting the plantings. (Both Justices Steven Breyer and Clarence Thomas had conflicts of interest in the case — Breyer’s brother was the District Court judge on the case, while Thomas was corporate counsel for Monsanto earlier in his career, but only Breyer saw fit to recuse himself.)
Despite the news reports claiming victory for Monsanto, the Supreme Court did not overturn the central tenet of the case: that the USDA prematurely approved Roundup Ready alfalfa. The District Court, in effect, made it once again illegal to plant Roundup Ready alfalfa — and the Supreme Court endorsed that ruling. While the Justices did declare that the USDA, if it wants to, has the right to give the seed a preliminary approval (i.e. for limited, restricted planting), the Supreme Court decision does not by itself give Roundup Ready alfalfa the green light.
And it’s important to note that the USDA has not yet formally announced any intention to re-authorize the restricted plantings, which would come in the form of a rule for “partial deregulation” of Roundup Ready alfalfa. In fact, the agency and Monsanto had preciously submitted such a plan to the District Court in hopes that it would be incorporated into the final ruling, and instead, they received an injunction.
To some, that move appeared to be an attempt at an end run around the official rulemaking process. It’s not clear if the USDA will move forward with anything other than the “final” environmental review.
[Update:] The USDA office that oversees biotech crops, the Animal and Plant Health Inspection Service (APHIS), just released a brief statement via email in response to the Supreme Court’s ruling. In it, the agency leaves the door open to some sort of preliminary approval for the alfalfa seed, without indicating its intention one way or the other: “APHIS is carefully reviewing the Supreme Court ruling before making decisions about its next regulatory actions related to the deregulation of Roundup Ready alfalfa.” It also announced its intention to complete the full environmental impact statement “in time for the spring planting of alfalfa crops in 2011.” That start date presumes they get through the process without any more lawsuits or injunctions — not a safe bet, at all.
No mo’ gene flow?
More importantly, the Supreme Court has also now ruled for the very first time that “environmental harm” includes economic effects such as reduced agricultural yield or loss of market due to genetic contamination, as well as the concept of what biologists refer to as “gene flow” (in practice, the idea that genetically engineered material may get into conventional plants through cross-pollination). The Supreme Court now accepts that this phenomenon in and of itself is harmful and illegal under current environment protections.
“That’s a huge win for our side … That’s gigantic!” Michael Hansen, senior staff scientist of Consumers Union, told me. Future lawsuits can now confidently use the gene-flow argument against approval and use of genetically engineered crops.
Others share his glee. The Center for Food Safety called the ruling “a victory for the Center for Food Safety and the farmers and consumers it represents.”
For its part, Monsanto is spinning the ruling positively. In a statement posted on its website, the company said: “This is exceptionally good news received in time for the next planting season. Farmers have been waiting to hear this for quite some time. We have Roundup Ready alfalfa seed ready to deliver and await USDA guidance on its release. Our goal is to have everything in place for growers to plant in fall 2010.”
Well, from all appearances Monsanto has this flat wrong. Farmers can’t plant Roundup Ready alfalfa just yet. And even if the USDA tries for that preliminary approval, the Supreme Court made very clear that today’s ruling does not presume that any preliminary approval is (or isn’t) legal.
Indeed, the legal issues at the heart of the ruling aren’t over the rights of corporations or the science behind genetically engineered seed, but about the separation of powers between co-equal branches of government. The Supreme Court today stopped a District Court from telling a federal agency that it couldn’t make regulatory rules. For the judiciary to stop the government from doing its job requires meeting a very rigorous set of standards. After the Supreme Court decided to make this point the crux of its ruling, all the other issues fell by the wayside. Another way of looking at it is that the supposed “overreach” by the District Court was against the USDA, not Monsanto.
The Supreme Court has also made the point very clearly that outside groups have the ability to file lawsuits in order to stop any poorly conceived or improperly executed rule that a federal agency passes. And surprisingly enough, the Court — with its expansion of the definition of “environmental harm” to include things like gene flow — just gave consumer groups a whole new set of legal weapons to wield against the same companies currently crowing over the implications of today’s events.
The apple suggests wholesome food. Nothing could be further from the truth. As if to underscore the destruction of the world’s food supply, the 33rd Meeting of the Codex Alimentarius Commission, July 5-9, 2010 (Geneva, Switzerland) approved a standard for apples which permits not more than 5% of the apples to be composed of FEEDING INSECTS!
