This is a letter written by Rima E. Laibow, M.D. to the Natural Nutritional Foods Association (NNFA), about the deceptive stance on Codex which is based on giving people wrong information about Codex (NNFA is telling people Codex is nothing to worry about). We are still waiting for a reply. In the meantime, NNFA has changed its name to “Natural Products Association” (NPA). Food has disappeared totally from its name.

Dear Ms. Taylor,
As the Medical Director of the Natural Solutions Foundation I would very much like to learn that our concern regarding the impact of Codex (which goes well beyond dietary supplements, as I am sure you are well aware) is no longer necessary. However, our concern rests on the following items and I would be happy to have your response, or that of the NNFA, on the following question:
The Sanitary and Phytosanitary Agreement, Article 3, makes it clear that member nations of the WTO have no choice but to bring their laws into compliance domestically with the standards of Codex. A Congressional Research Service report on this question prepared for Representatives Paul and DeFazio comes to the same conclusion: the U.S., under current agreements and treaties, has no choice but to comply with Codex domestically since Article VI, clause 2 of the U.S. Constitution give supersedence to treaty law (WTO) over domestic law. Given the clear constitutional mandate this imposes upon the U.S. to bring its domestic laws into conformity with Codex, and given the clear intent of Codex to use Risk Assessment Science, founded in toxicology (and focused on providing dose levels so low that they can be shown to be free of any discernable impact on human being) to establish maximum permissible upper limits on a severely restricted number of nutrients, how can the NNFA, in good conscience, continue to mislead its members and the general public into believing that Codex will not impact on domestic law, specifically DSHEA?
This is a crucial issue and I look forward to your reply at your earliest convenience so that, if the issue is not a significant one, as you organization maintains, in terms of U.S. markets, we can inform our network of that. On the other hand, if you are not able to sustain your argument in the face of constitutional law and international agreements, then I think it incumbent upon your organization to make the change in position clear to your members and the general public.
