One important story Alex reported is that the FDA has admitted that dental mercury can be harmful.

“For the first time, the FDA has issued a warning that the mercury contained in silver dental fillings may pose neurological risks to children and pregnant women.”

This admission is an important victory in the struggle for Health Freedom. Similar to the efforts of CDC to placate people by “removing” mercury from vaccines (we know that “trace” but still harmful amounts of mercury remain). Small steps toward more transparency and greater personal choice keep us going to our greater goal of significant individual control over our own healthcare choices.

And that brings me to the more general strategic question: how do we turn such individual victories into a general victory in the war (yes, it IS a war) for Health Freedom?

Sometimes what appears to be an isolated win reverberates into the future on multiple fronts. One example involves the Natural Solutions Foundation’s efforts last year when the 2007 FDA amendment bill was introduced in Congress by Sen. Kennedy. His idea was to deal with the failures of the FDA (what Dr. Ron Paul called “FDA abuse of power…”) and which Congress documented clearly in a November, 2007 report (Click Here – http://www.healthfreedomusa.org/index.php?p=1482 -for details) by giving the agency more power, rather than dealing with its structural and functional failures.

Or the stunning victory pulled off by the Foundation when, through its scientific dossier on fluoride in babies and children, we marshaled enough voices to keep Fluoride out of baby formula for healthy babies against the vigorous opposition of the FDA at a 2006 major Codex meeting.

In 2007 the Health Freedom Movement insisted that a clause be added to the bill protecting our Dietary Supplements from new FDA interference. We were told by various political and movement “old hands” and “insiders” that it didn’t matter (after all, they said, “the bill doesn’t even MENTION Dietary Supplements”). We saw this as incredibly naïve and persisted, even after the saving clause was in the bill, because we knew the protective language might not survive the House – Senate conference. You sent huge numbers of messages to Congress and, we believe, because of your efforts, the clause protecting dietary supplements survived the Conference Committee.

So here it is a year later… and guess what? FDA recently tried a flanking move, attempting to drag Dietary Supplements into the new law by seeking “public comments” specifically about Dietary Supplements, focusing on an arcane section of the new law.

Last week we alerted you and you responded to our emergency Action eAlert. Once again, large numbers of our “net roots” powerfully told the FDA, in no uncertain terms, to leave our supplements alone, shortly before the end of the FDA’s comment deadline.

Well, the same “old hands” are at it again. Said we were being “alarmists” and the FDA’s request for comments wasn’t a threat.* We think that is absurd! The FDA is committed to the destruction of the high potency supplements you and I take to protect, gain and regain our health. Just look what they’ve done in Europe through their malignant “leadership” at Codex!

These same “old hands” who are supposedly part of the Health Freedom Movement even say (Fasten your seat Belts for this one!) that Codex is not a threat and the not-finalized anti-CAM FDA guidance document from December 2006 that we warned everyone about wasn’t a threat, and… well, you get it.**

If they are really on our side, why are they’re telling the people to go back to sleep? And why are they spreading rumors, lies and disinformation about the Natural Solutions Foundation and its leadership? Maybe you heard the one about how, they say, I tried to walk through walls when I was serving our country in the US Army. Never did that one… though if I could find a way to keep our soldiers out of harm’s way by walking through walls, I’d do it!

Or about how Dr. Rima, who has practiced drug free psychiatry and medicine for her entire career, “made her living by using electroshock ‘therapy’ on children and using psychiatric drugs”. In fact, Dr. Rima turned down a prestigious appointment to a major University because it required her to either administer, or supervise, electroshock treatments. And the disinformation about Counsel Ralph saying that he ‘abandoned’ a doctor in a battle for her license when no such event ever occurred. Or that we work for the ‘bad guys,’ and so on and on and on. But the lies and silly rumors continue… why do they do it?

Is it perhaps because the Natural Solutions Foundation is THE single most effective, and the largest, health freedom organization in the world?

We know why and we know better, as do you. “Don’t sleep when you’re on guard duty!”

So if you hear someone saying that we are alarmists, you can tell them you are grateful that we are here to pull the alarm switch when the house is being set on fire!

* Our co-trustee and counsel Ralph Fucetola JD tells us that asking for comments is the first step the FDA takes before issuing regulations, so he believes the agency does want to subject Dietary Supplements to Section 301(11) of the 2007 act, which allows the agency to forbid interstate commerce in certain circumstances. Oddly enough, there are people who do not see that this request for comments is a preamble to forbidding supplements from interstate commerce. They’ll come around later. They pretty much always do.

** Of course the CAM guidance never became a threat; to this date it has not been finalized, because 198,000 of you succeeded in filing protests before the FDA comments site went down… and a half million tried to file their objections! All because our Action eAlert “went viral” with your help and reached millions of people.

The Chairman of our Advisory Board, Larry Deckerhoff, MIM, shared his opinion with us, “It is apparent that the demise of IRAs and of 401 contribution plans is imminent. Not only are a number of firms (such as Ford) canceling all future employer contributions, the government is also preparing to assume greater control over all retirement funds in order to pay for the bailouts and deficits. This is basically a tax increase. Protecting your retirement funds through offshore participation in real value investments is both prudent and possible – at least for now. How long that option will remain open is anyone’s guess, but it there is clearly a window of opportunity which appears to be shutting rapidly.”

Is there any strong chance they could win?

None [of the major party candidates] understood anything close to what would make the necessary links to empowering truth and overshadowing the ignorance that perpetuates the blind sheep syndrome toward the sheer precipice into where? Certainly not hope, life and what should be a birthright of open ended possibilities filled with no fear of discovery, knowledge and wonder! Maybe even joy!

Here is my reply:

YOU ARE RIGHT! These issues are very serious. We have been sounding the alarms and finding effective strategies to deal with these issues for a long time now.

Not enough people understand that the threats are incredibly serious. But we have numbers and strong information on our side, despite the misguided (or worse) attacks on us for raising these alarms. They need to be raised and our side, the net roots, the consumers and the voters, need to come together to back down the drug hawkers and the globalists who want us ill for profit (or worse).

That is why we urge everyone who reads our emails – and they number in the 10s of millions – to become a part of the solution:, send the Action eAlerts to Congress and the FDA, forward the mails and ask your friends to do the same …and for Health’s sake, support us.

Here’s an example of what indifference (or worse) means when people take these battles for granted or do not realize that they have a part in the battle:

This past April in Ottawa at the Codex Committee for Food Labeling (CCFL) we helped to galvanize Pan-African dissent to the US bulling through unlabeled GMOs in Codex. The results were dramatic: South Africa (SA) presented their National Position Paper clearly showing that Codex already contained language and precedents which made the international trade of GMO foods and seeds ILLEGAL! Africa rallied around SA. We made sure that a copy of SA’s position paper was in the hands of every potential member of the “Coalition of the Unwilling” that we have been carefully building for a number of years on this topic.

The US had suffered a direct hit! But the next morning, SA was forced by the irate and frantic calls of the US to SA’s Minister of Health and President to force them to withdraw their country’s submission! Africa went nuts! The delegates were enraged and pulled together to form a tight alliance.

The next time this issue was set to come forward in Codex (vitally important to YOUR food supply as well as that of the underdeveloped nations) was at another Codex meeting IN South Africa last month. We were not there.

Why? Because too many people got too complacent about the battle, allowed themselves to be distracted and forgot to make a donation of even $1 per month. Natural Solutions Foundation did not have the money for the trip. We definitely lost ground. We cannot afford to lose any more ground. We are poised on thresholds of victory in so many areas: Dental mercury, Communities rejecting fluoride in their water, Legislation to require GMO testing and labeling, etc. But we must have the resources!

You know what the wise nursery rhyme says:

The study found, in part, that the FDA is institutionally incapable of protecting the food supply. Nor, we believe, does it want to.

What’s the natural solution? To protect ourselves and our foods (that is, our health) we must divest the FDA of food authority, just like the FDA was divested of authority over controlled dangerous substances a couple decades ago when the DEA was established. You know, of course, FDA is “down regulating” foods, including dietary supplements and natural remedies, while supporting dangerous drugs. How dangerous? Take a look at what the CDC, a unit of the FDA, published on this topic in 2007. Note that these statistics only go as far as 2004. Numerous separate studies show that the rate has increased dramatically since then.

The solution is clear because the situation is intolerable. Maybe it made sense to combine these functions when the agency was created early in the 20th century because most drugs were derived from foods. It no longer makes sense and the time to end this deadly conflict of OUR interests in now.

SUMMARY: Organizer’s Handbook & Answering Your Emails.

I’m the lady who answers your emails! I am the person who you write to, sometimes with wonderful complements and sometimes complaining about our spelling skills (or lack thereof). I usually write from midnight until about 6 am after which I collapse and then get up and do some more! I put in a lot of hours and we get a LOT of email, so please be patient if it takes several days for me to get to your question. I am an aging hippy – a flower kid of the 60s who has worked in pro-freedom groups since then and was brought into the health area by friends Durk Pearson and Sandy Shaw.

I am a libertarian-thinking freedom lover with the blood of many American Revolutionaries in my genetic line, so I cannot help but do this work – they make me do it ;).

I must say that we have the very best of the best people on our email list. You are also great spellers and do not hesitate to let us know that we are not very good at that skill. You also let us know when our links do not work (being fixed!!) or when our format is “too busy”. Stick with us – we can only get better and we are the largest and most active profreedom group in the country.

Divesting the FDA of Food Authority

It’s been a year since an official government study of the FDA said:

1) The FDA cannot fulfill its mission because its scientific base has eroded and its scientific organizational structure is weak.
2) The FDA cannot fulfill its mission because its scientific workforce does not have sufficient capacity and capability.
3) The FDA cannot fulfill its mission because its information technology (IT) infrastructure is inadequate.
4) FDA does not have the capacity to ensure the safety of food for the nation.
5) The development of medical products based on “new science” cannot be adequately regulated by the FDA.
6) There is insufficient capacity in modeling risk assessment and analysis.
7) The FDA science agenda lacks a coherent structure and vision, as well as effective coordination and prioritization.
8) The FDA has substantial recruitment and retention challenges.
9) The FDA has an inadequate and ineffective program for scientist performance.
10) The FDA has not taken sufficient advantage of external and internal collaborations.
11) The FDA lacks the information science capability and information infrastructure to fulfill is regulatory mandate.
12) The FDA cannot provide the information infrastructure support to regulate products based on new science.

The FDA is a failed agency that, in Dr. Ron Paul’s words engages in “abuse of power.”

I believe that due to its focus on the drug industry (80% of its funding comes from Big Pharma “user fees”) and its failure to protect the safety of the food supply, while engaging in international “HARMonization” that degrades organic standards and allows ever-increasing levels of toxins (including antibiotic residues) in the food supply, the FDA is incapable of administering food regulations.

The FDA’s prejudice against nutrient supplementation and traditional, natural remedies means these advanced healthcare alternative competitors to pharmaceuticals are denigrated, marginalized and regulated against.

What is the answer? It is to, in the immortal words of John Galt, “Get out of the way.” We need to engage market forces to stimulate advanced alternatives to a medical system that is now the major source of death in our society. We need to divest the FDA of any authority over foods. Maybe then it can focus on the dangers of pharmaceuticals, including the uninsurable risks of vaccinations.

We need to free Foods (including nutrients and natural remedies) from the deadly hands of the FDA.

The FDA has implied interest in imposing a patently illegal restriction on the interstate commerce of nutrients and supplements if there has EVER been a scientific study published about the supplement.

Not only is that insane, creating a new category of dangerous substances that might be called “Anything anyone has ever studied that competes with drugs”, it is also in direct violation of US law, to say nothing of the Constitution of the United States.

The law it violates is a provision of the 2007 FDA Authorization Act that clearly states nothing in the Act shall apply to products covered by DSHEA, the 1994 Dietary Supplements Health and Education Act. Nonetheless, FDA is now questioning whether the Act’s Section 301(11) provision allowing FDA to stop interstate commerce in food substances ever studied for possible drug approval applies to dietary supplements (for details see the copy of our statement to the FDA below).

So this bizarre twist of logic, ingenious as it is, has nothing to do with legal authority by the FDA to ban supplements from interstate commerce – which it does not have.

But think about why the FDA would want to do that. Clearly, because nutrients are the single most significant economic competitor to drugs. Drugs are expensive. Nutrients are cheap. Drugs are dangerous. Nutrients are safe. Drugs kill people (23% of all adverse reactions reported to the FDA are fatalities). Nutrients do not kill people. Drug sales are reportedly off 13% in the economic downturn. Could it be that the pharmaceutical industry, which literally owns FDA decision making capacity (through permitted conflicts of interest, revolving door policies which put corporate executives in executive positions in the FDA and then the titles switch so that the same person now has a corporate executive position instead of an FDA position) and through user fees might be serving the interests of its economic masters? It certainly appears that way.

Comments of Natural Solutions Foundation to the FDA Regarding Comments Request

Natural Solutions Foundation is a Non-Governmental Organization (NGO) consumer group organized as an exempt entity in the United States (State of Nevada) and in several other countries. Our primary web site is www.HealthFreedomUSA.org and we have over 185,000 supporters, primarily Americans.

These comments address the third question raised by FDA in its call for comments, namely how the Section 301(11) restrictions on commerce might apply to dietary supplements, thereby restricting consumer choice.

National Solutions Foundation was one of the institutions that helped educate members of Congress and other decision makers regarding the relationship of Dietary Supplements regulated under the Dietary Supplement Health and Education Act of 1994 (DSHEA) to the enhanced authority granted FDA by Congress in the 2007 Food and Drug Act Amendments.

Due to determined public expression, including messages to Congress by hundreds of thousands of citizens, section 1011 of the Act was included, the Rule of Construction that states, “Nothing in this title (or an amendment made by this title) shall be construed to affect– (1) the regulation of dietary supplements under the Dietary Supplement Health and Education Act of 1994 (Public Law 103-417)”

The 301(11) restrictions must be interpreted under the exemption for DSHEA products intended by Section 1011. As a result, DSHEA products must be allowed in interstate commerce without interference by the provisions of section 301(11).

However, the same requirement of law does not apply to food products that contain “trace” or more amounts of extraneous hormones, pesticides, pharmaceuticals, including antibiotics, irradiation break-down products and other toxins introduced to food during its processing. Such adulterated foods should not be on the market.

In its unseemly reach for more authority to restrict consumer choice in nutrients the FDA seeks to ignore the plain Congressional intent of Section 1011 and the unanimous Congressional intent of DSHEA that Dietary Supplements are foods, deemed safe when used as directed.

In this way, FDA continues to exhibit why it is time for Congress to consider divesting FDA of its food authority. FDA has failed to protect the American food supply and is institutionally incapable of responding constructively to consumer choice in nutrition.

Gardasil seems to be beset with problems

More complications with Merck, the pharmaceutical producers of the HPV vaccine Gardasil. Uncommon knowledge, tucked away on the New York Times webpage of Feb. 21, 2007, is the promise by Merck to quit lobbying U.S. state legislatures. An angry backlash from parents, advocacy groups and public health experts across the U.S. forced Merck to back down due to possibly jeopardizing its sales.
Originally most state legislatures wanted mandatory HPV inoculations. But now that has generally been replaced. As Lawrence Gaston of Johns Hopkins University notes: “A response to the rush to mandate could backfire on us with public dissatisfaction as a deterrent to all vaccinations.” Many state legislatures are now advocating a five-year moratorium on mandatory inoculation to further review the drug’s efficacy. In any case, most states allow parental opt-out provisions.
Over an over, in medical journals, newspaper articles and health networks, the overruling question is why has Gardasil been rushed to market without proper and extensive testing techniques? (Gardasil is still in the testing stage and will not be fully evaluated for safety until September 2009.) So it begs the question: how was FDA able to OK its marketing in 2006?
In a Globe and Mail article last year entitled: “How Politics Pushed the HPV Vaccine,” was included a graph showing the rate of cervical cancer mortality in Canada between the years 1970 and 2005. By 2005 cervical cancer deaths had dropped to .003 per cent of the female population. While unfortunate, hardly a public health crisis.
Aluminum is a troubling ingredient in Gardasil. For each 0.5-ml dose, there are 225 mcg of aluminum. As one medical specialist observed: “Aluminum needs a hard look as a vaccine component as mercury does. We are learning it also causes cell death – a lot of cell death – in the brain.”
Medical practitioners can record patient reactions to vaccinations through VAERS (Vaccination Adverse Events Record System). Unfortunately, recording vaccination events is not mandatory, so VAERS only reflects about 10 per cent of patients’ distress. It cannot indicate adverse events in any accurate measure. Nevertheless, it helps to glean some idea of Gardasil’s dangers.
Judicial Watch.org is a public interest group that investigates and prosecutes government corruption. It has been regularly tracking the FDA’s HPV vaccine records. By now it has discovered more than 8,000 side-effects, as well as deaths, and has detailed its concerns.
